1. Scope and Acceptance
These Terms apply to the Orbit iPhone app (the “App”), https://orbit.wpppc.cn (the “Website”), and the relationship between you and the developer arising from your access to the Website or use of the App.
Please read these Terms before accessing the Website or using the App. By continuing, you acknowledge that you have read and understood these rules. Whether and to what extent these Terms bind you depends on applicable law, applicable Apple terms, and any prominent notice or consent legally required. If you do not accept them, stop accessing or using the Website or App. A user who needs consent from a parent, guardian, or other authorized person under applicable law should obtain it first.
Nothing in these Terms excludes or limits mandatory consumer-protection, privacy, or other statutory rights.
2. The Current Product
Orbit is a local-first iPhone tool for business records and feedback. You can organize Workspaces, products, categories, tags, record fields, orders and other records around the way you work, then review metrics, goals, trends, and charts.
The current version does not require an Orbit account and does not provide Orbit cloud sync. The Website is a static product and support site. It does not provide sign-in, online data storage, or Website access to the business records held in the App.
The Website describes only confirmed current capabilities. Designs, previews, roadmaps, or discussions of future versions are not promises about features, timing, pricing, or continued availability.
3. App Store and Apple Terms
When you obtain the App through the Apple App Store, the App is licensed, not sold. Unless the App Store product page presents a custom end-user license agreement from the developer, the App license is governed by Apple’s Standard End User License Agreement and the Apple Media Services Terms and Conditions.
These Website Terms describe Website access, confirmed product facts, privacy, support, and other matters outside the App license. They do not replace or amend the applicable Apple license or store terms. Sections 4 and 11 do not create a separate App license or reduce rights given to you by Apple’s terms or mandatory law. If there is a conflict, Apple’s terms control within their scope, and mandatory law always controls.
Apple is not responsible for the Orbit product support that the developer is required to provide. Contact the developer about the App itself, its content, privacy, or legal compliance. Apple’s responsibilities and third-party-beneficiary rights are governed by the applicable Apple terms.
4. Permitted Use
You may use the App for your lawful personal or business purposes on Apple devices that you own or control, as permitted by the applicable Apple Usage Rules, and you may browse the Website.
Unless applicable law, Apple’s terms, or an open-source component license expressly allows it, you may not copy, redistribute, rent, sell, sublicense, reverse engineer, decompile, attempt to derive source code from, modify, or create derivative works of the App.
- Do not use the App or Website for unlawful, fraudulent, infringing, or harmful conduct;
- do not bypass security measures, interfere with normal operation, or access systems without authorization;
- do not impersonate another person, misrepresent the source of content, or place an unreasonable automated load on the Website; and
- follow the applicable terms for your device, network, App Store, and other third-party services.
5. Your Business Records
You retain your rights in the business information you create or enter in the App. These Terms do not give Orbit ownership of those local records.
You are responsible for the legality, accuracy, and appropriateness of the information you enter. If a record concerns a customer, employee, supplier, or other person, make sure you have a lawful basis and record only what is necessary for your business purpose.
Do not use Orbit to store unlawful material or passwords, financial-account credentials, identity-authentication material, or other high-risk sensitive information unrelated to the business purpose.
6. Local Data and Data Care
The App stores business data on your device. The developer does not provide an Orbit server backup or Orbit cloud sync and cannot retrieve, restore, or modify that local data from a server.
Protect access to your device and manage Apple device or iCloud backup settings according to your needs. Permanently deleting records, uninstalling the App, erasing or resetting the device, device damage or loss, and restoring a backup from a different point in time may affect data availability.
If the law requires you to retain business, accounting, tax, or other records, you are responsible for identifying and meeting that obligation. Orbit’s local storage state does not replace your legal recordkeeping responsibilities.
7. Metrics, Charts, and Business Decisions
Orbit’s metrics, goals, trends, charts, and feedback are generated from the data you save, the scope you select, and configured rules. Results may be incomplete or unable to form a reliable comparison when inputs are incomplete, inaccurate, or lack sufficient history.
Orbit helps you record and understand a business. It does not provide accounting, audit, tax, legal, investment, or other professional advice. Check the underlying records and consult a qualified professional when needed before making filing, pricing, employment, financing, or other important decisions.
8. Privacy and Support
The Privacy Policy explains the actual handling of local App data, user-selected images, Apple-provided aggregate analytics and diagnostics, Website logs, and support email, and forms part of these Terms.
You may voluntarily email support through the Support page. A user in mainland China should first review the international-processing notice and provide the separate confirmation shown there. Support email is retained for one year after the last correspondence and is handled under the exceptions and deletion process stated in the Privacy Policy.
Provide only the information reasonably needed to resolve a support request. Do not send passwords, a complete business database, financial-account details, or sensitive information unrelated to the issue.
9. Intellectual Property
Intellectual-property rights in the App, Website, Orbit name and marks, interface design, software, text, graphics, and other content created by the developer belong to the developer or the applicable rights holder.
These Terms allow you to use the App and Website for their intended purpose. They do not transfer any trademark, copyright, patent, source-code, or other intellectual-property right. Third-party names, marks, and content remain the property of their respective owners.
10. Updates and Availability
The developer may provide updates through the App Store and revise Website content to improve the product, fix issues, protect security, support system changes, or comply with law. Updated features and interfaces may differ from earlier versions.
The developer will take reasonable measures to maintain the App and Website but cannot guarantee that every device, system version, network condition, or third-party service will always be available. The Website or support channel may be temporarily interrupted by maintenance, a security event, or circumstances outside the developer’s control.
If the developer decides to discontinue the Website or support channel on a long-term basis, the developer will publish effective contact or transition information where reasonably practicable. Continued access to local data depends on the device, installed App version, and Apple platform conditions.
11. Warranties and Responsibility
Please pay particular attention to this section. To the extent permitted by applicable law, the App and Website are provided in their currently available state. The developer makes no warranty beyond what these Terms, the product page, or mandatory law expressly requires.
These Terms do not exclude or limit consumer rights that cannot legally be excluded, or liability arising from the developer’s intentional misconduct, gross negligence, or another circumstance for which the law does not permit limitation.
To the extent permitted by law, the developer is not responsible for loss caused solely by inaccurate input, unauthorized or unlawful use, device failure or loss, failure to keep a necessary backup, or a third-party platform or network failure, except where the loss is attributable to the developer or the law provides otherwise.
12. Ending Use
You may stop visiting the Website or uninstall the App at any time. Uninstalling or deleting may affect local data, so review the device and backup state first.
If you seriously breach these Terms or use Orbit to infringe another person’s rights, the developer may require you to stop the conduct and may take lawful, proportionate measures. Provisions concerning intellectual property, responsibility, disputes, and matters that must continue by law remain effective after use ends.
13. Governing Law and Disputes
Mandatory consumer-protection and other laws in your place of residence continue to apply. For a user in mainland China, these Terms are governed by the laws of the People’s Republic of China, without affecting any mandatory law that applies.
If you have a question or dispute, contact the developer through the support address first so the facts can be reviewed and a resolution can be explored. If the matter is not resolved, either party may lawfully use mediation, complain to a competent authority, or bring a claim in a court with jurisdiction. These Terms do not force you to give up a legally available choice of dispute-resolution method.
14. Changes and Contact
The developer may update these Terms and the effective date when the product, legal requirements, or service arrangements change. A change that materially affects your rights or obligations will receive reasonable notice on the Website, and consent will be obtained where required by law.
